These Terms of Service (“Terms”) apply to your access to and use of Verluma Academy, including our website, digital courses, downloadable materials, private tutoring, lesson packages, email communications, and related services.

Verluma Academy is operated by Henrich Kotlán - Lektor (“Verluma Academy,” “we,” “us,” or “our”).

Please read these Terms carefully before purchasing or using our services.


1. Acceptance of these Terms

By accessing or using the Verluma Academy website, creating an account, purchasing a course, downloading materials, booking private tutoring, purchasing a lesson package, subscribing to emails, or otherwise using our services, you agree to these Terms and to our Privacy Policy.

If you do not agree with these Terms, you should not use our services.

These Terms may be updated from time to time. The version published on the website at the time of your purchase or use will apply unless a later version is required by law or clearly communicated to you.


2. About Verluma Academy

Verluma Academy provides German language education, including:

·         prerecorded digital German courses;

·         course materials such as PDFs, vocabulary lists, phrase lists, exercises, reading texts, and other downloadable or printable materials;

·         private German tutoring through Zoom or similar online tools;

·         lesson packages;

·         email updates, learning tips, and marketing communications.

Our courses and lessons are designed for language learning and educational support. They are not official certificates, government-recognized qualifications, or guarantees of exam success.


3. Accounts and access

Some services require an account through Podia or another platform. You are responsible for keeping your login details secure and for all activity under your account.

You must not share your login details with other people, give others access to paid course content through your account, or use another person’s account without permission.

We may suspend or restrict access if we reasonably believe that an account is being misused, shared unlawfully, used for copyright infringement, used for fraud, or used in a way that harms Verluma Academy, other users, or our service providers.


4. Digital courses and course materials

When you purchase a digital course, you receive access to the course content made available through the relevant platform. This may include video lessons, written materials, exercises, vocabulary documents, phrase lists, reading texts, tests, and downloadable or printable PDFs.

Course access is personal and non-transferable. Unless we clearly state otherwise, your purchase gives you a limited right to use the course for your own personal learning only.

You may download and print provided materials for your own personal study. You may not copy, resell, upload, share, distribute, publish, teach from, reproduce, modify, or commercially exploit the course content or materials without written permission from Verluma Academy.


5. Intellectual property

All course videos, scripts, explanations, exercises, vocabulary materials, phrase materials, PDFs, graphics, texts, branding, logos, and other content provided by Verluma Academy are protected by copyright and other intellectual property rights.

You may use the materials only for your personal learning. You may not:

·         share course videos or downloads with others;

·         upload materials to public or private file-sharing platforms;

·         sell, license, rent, or redistribute materials;

·         use the materials to create competing courses or teaching products;

·         remove copyright notices or branding;

·         record, copy, or republish course videos;

·         use the materials for commercial teaching without written permission.

Violation of this section may result in loss of access and may lead to legal action where appropriate.


6. Payments

Payments may be processed through Podia, Calendly, Stripe, PayPal, or other connected payment providers.

You agree to provide accurate payment and billing information. Prices are displayed at checkout before purchase. By clicking the relevant purchase or payment button, you agree to pay the displayed price for the selected product or service.

We do not intentionally store full credit card numbers or payment card security codes ourselves. Payment processing is handled by the relevant payment provider.

Currency, taxes, transaction fees, and payment-provider rules may depend on your location and the payment method used.


7. Digital course refunds and right of withdrawal

Digital courses are delivered online and may include immediate access to video lessons, downloadable PDFs, printable materials, tests, and other digital content.

Because digital products can be accessed immediately after purchase, course purchases are generally non-refundable once access has been granted, except where required by applicable law or where we decide to make a goodwill exception.

If you are a consumer in the European Union or another jurisdiction with a statutory right of withdrawal, you may normally have a legal right to withdraw from a distance contract within a certain period. However, for digital content that is supplied immediately and is not provided on a physical medium, this right may be lost once digital content has begun to be supplied, if the legal requirements for immediate access and acknowledgement of withdrawal loss are met.

By purchasing a digital course and receiving immediate access to the course content, you request immediate delivery of the digital content. To the extent permitted by applicable law, you acknowledge that you may lose your statutory right of withdrawal once access to the digital content is provided.

If applicable law requires a separate express consent or acknowledgement that is not validly obtained during checkout, your mandatory consumer rights remain unaffected.

If you believe you have a legal right to withdraw or request a refund, contact us at hello@verlumaacademy.com. We will review the request according to applicable law and the circumstances of the purchase.


8. Private tutoring

Private tutoring lessons are provided online, usually through Zoom.

Each private lesson is 55 minutes long, unless clearly agreed otherwise.

Private tutoring may cover German language learning, conversation practice, grammar, pronunciation, writing, exam preparation, course support, or other language-related goals agreed between the student and teacher.

Private tutoring is available for adults and students aged 16 or older. Students aged 16 or 17 should participate only with the consent and involvement of a parent or legal guardian, especially for payment, booking, and communication.


9. Booking, rescheduling, cancellation, and no-shows

Private lessons are booked through Calendly or another scheduling tool.

You may reschedule or cancel a private lesson free of charge up to 12 hours before the scheduled lesson time.

If you cancel or request to reschedule less than 12 hours before the scheduled lesson time, the lesson may be counted as used and may not be refunded or rescheduled, except where required by law or where we choose to make an exception.

If you do not attend a scheduled lesson and do not cancel in time, this is considered a no-show. A no-show lesson may be counted as used and may not be refunded or rescheduled.

If the teacher must cancel or reschedule a lesson, you will be offered a new lesson time or another appropriate solution.


10. Lesson packages

Verluma Academy may offer packages of multiple private lessons, including 10-lesson packages.

A 10-lesson package includes ten private lessons of 55 minutes each, unless clearly stated otherwise.

Lesson packages are valid for 6 months from the date of purchase. Unused lessons expire after the validity period unless we agree to extend the package.

Package lessons follow the same cancellation, rescheduling, and no-show rules as individual private lessons.

Unused package lessons are generally not refundable, except where required by applicable law or where we choose to make a goodwill exception.

Lesson packages are personal and may not be transferred to another person without written permission from Verluma Academy.


11. Loyalty lesson package

Verluma Academy may offer a discounted loyalty lesson package.

The loyalty package is available only to:

·         students who had lessons with Henrich Kotlán / Verluma Academy before 1 June 2026; or

·         students who have completed at least 25 previous private lessons with Henrich Kotlán / Verluma Academy.

If a person purchases the loyalty package without being eligible, we may cancel and refund the purchase, refuse access to the package, or ask the person to pay the difference between the loyalty package and the standard package price.

The loyalty package is subject to the same booking, cancellation, rescheduling, no-show, validity, and package rules as other lesson packages, unless clearly stated otherwise.


12. Student responsibilities

You are responsible for:

·         providing accurate information when purchasing or booking;

·         attending lessons on time;

·         checking your time zone carefully when booking;

·         having a working internet connection, microphone, camera if needed, and suitable device;

·         preparing for lessons where appropriate;

·         communicating respectfully;

·         using course materials only for personal study;

·         keeping account and meeting links private;

·         informing us in advance about relevant goals, exam needs, or learning preferences.

We are not responsible for missed lessons or technical problems caused by your device, internet connection, incorrect time zone settings, failure to check emails, or failure to attend the scheduled session.


13. Teacher responsibilities and service limitations

We aim to provide clear, structured, high-quality German language education. However, language learning depends on many factors, including your starting level, consistency, practice, motivation, time investment, and personal circumstances.

We do not guarantee:

·         that you will reach a specific German level within a specific time;

·         that you will pass a Goethe, telc, ÖSD, or other exam;

·         that private lessons alone will be sufficient for your goals;

·         that all technical platforms will always be available without interruption;

·         that all materials will be error-free at all times.

If we discover an error in course materials, we may correct it, update the material, or provide clarification.


14. Exam preparation disclaimer

Verluma Academy may help students prepare for German exams such as Goethe, telc, ÖSD, school exams, university exams, or other language assessments.

However, Verluma Academy is not affiliated with these examination providers unless explicitly stated, and we do not guarantee exam admission, exam results, passing scores, certificates, or acceptance by any institution.

Students are responsible for checking official exam requirements, registration rules, dates, fees, identification requirements, and exam formats with the relevant exam provider.


15. Acceptable use

You agree not to use the website, courses, materials, private lessons, or platforms in a way that:

·         violates applicable law;

·         infringes intellectual property rights;

·         harasses, threatens, abuses, or discriminates against others;

·         attempts to gain unauthorized access to systems or accounts;

·         disrupts the website, course platform, booking platform, or lessons;

·         shares paid content with unauthorized users;

·         records private lessons without permission;

·         uses course content for commercial purposes without permission;

·         uploads malicious software, spam, or harmful content.

We may suspend or terminate access if these rules are violated.


16. Third-party platforms

Our services rely on third-party platforms such as Podia, Calendly, Zoom, Stripe, PayPal, and Google/Gmail.

Your use of those platforms may also be subject to their own terms, privacy policies, payment rules, account rules, and technical requirements.

We are not responsible for outages, payment failures, account restrictions, technical issues, or policy decisions caused by third-party platforms, although we will try to assist where reasonably possible.


17. Privacy

Your use of Verluma Academy is also governed by our Privacy Policy, which explains how we collect, use, store, and protect personal data.

By using our services, you acknowledge that you have read or had the opportunity to read our Privacy Policy.


18. Availability and changes to services

We may update, change, improve, reorganize, or discontinue parts of our services from time to time.

For digital courses, we aim to maintain reasonable access to purchased course content. However, access may depend on the continued operation of third-party platforms, account status, payment status, and compliance with these Terms.

We may update course materials, correct mistakes, improve explanations, replace files, or modify the course structure where appropriate.


19. Termination or suspension of access

We may suspend or terminate access to courses, downloads, accounts, lessons, or services if:

·         payment fails or is reversed;

·         a refund or chargeback is issued;

·         you violate these Terms;

·         you share or misuse course content;

·         you behave abusively or unlawfully;

·         continued access would create legal, technical, security, or business risk.

Where reasonable, we will provide notice or an opportunity to resolve the issue, but this may not always be possible or required.


20. Consumer rights

Nothing in these Terms is intended to remove or limit mandatory consumer rights that apply to you under applicable law.

If a provision of these Terms conflicts with mandatory consumer protection law, the mandatory legal rule will apply.


21. Limitation of liability

To the fullest extent permitted by applicable law, Verluma Academy is not liable for indirect, incidental, special, consequential, or punitive damages, including loss of profit, loss of opportunity, loss of data, exam failure, technical problems, platform outages, or interruptions outside our reasonable control.

Our total liability for a claim related to a paid product or service will not exceed the amount you paid for that specific product or service, unless applicable law requires otherwise.

This limitation does not exclude liability that cannot be excluded under applicable law.


22. Force majeure

We are not responsible for failure or delay caused by events outside our reasonable control, including internet outages, platform failures, payment provider problems, illness, emergencies, natural disasters, government restrictions, strikes, war, cyberattacks, or other events that make performance impossible or unreasonably difficult.

If such an event affects a scheduled private lesson, we will try to reschedule or provide a reasonable alternative.


23. Governing law

These Terms are governed by the laws of Slovakia, unless mandatory consumer protection laws in your country of residence require otherwise.

If you are a consumer in the European Union or another jurisdiction with mandatory consumer rights, you may still benefit from the mandatory protections of your local law where applicable.


24. Dispute resolution

If you have a problem with a course, lesson, payment, booking, or other service, please contact us first at hello@verlumaacademy.com. We will try to resolve the issue fairly and directly.

Any disputes that cannot be resolved informally will be handled according to applicable law and the governing law section above, while respecting mandatory consumer rights.


25. Changes to these Terms

We may update these Terms from time to time.

The updated version will be posted on the website with a new “Last updated” date. If changes are significant, we may provide additional notice where appropriate.

Your continued use of the services after updated Terms are posted means that you accept the updated Terms, unless applicable law requires a different process.

For purchases already completed, the Terms in effect at the time of purchase generally apply to that purchase unless a change is required by law or is more favorable to you.

27. Implementation note

These Terms are designed for Verluma Academy’s current services: digital German courses, downloadable learning materials, private Zoom tutoring, 10-lesson packages, Podia hosting, Calendly scheduling, Stripe/PayPal payments, and Podia-based email marketing.

They should be reviewed and updated if Verluma Academy adds new services, mobile apps, memberships, community features, lesson recordings, new analytics tools, advertising pixels, a separate email provider, a public business address, or materially different refund/cancellation rules.
